This website is operated by DLV Jewelry, a brand of Dev Labtech Venture Limited. Throughout the site, the terms “we”, “us” and “our” refer to DLV Jewelry. We offer this website, including all information, tools and services available from it, to you the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site or purchasing something from us, you engage in our Service and agree to be bound by these Terms of Service, including the additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the site.

Please read these Terms carefully before using our website. If you do not agree to all of them, you may not access the website or use any of its services. Any new features or tools added to the store are also subject to these Terms. We may update, change or replace any part of them by posting the change to this page, and it is your responsibility to check it periodically. Your continued use of the site after a change constitutes acceptance of it.

1. Online store terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are of the age of majority and have given us consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose, nor may you violate any laws in your jurisdiction, including copyright laws. You must not transmit any worm or virus or any code of a destructive nature. A breach of any of these Terms will result in immediate termination of your Services.

2. General conditions

We reserve the right to refuse service to anyone, for any reason, at any time.

You understand that your content, not including payment details, may be transferred unencrypted and may involve transmission over various networks and changes to conform to the technical requirements of connecting networks or devices. Payment details are entered on our payment provider’s own secure pages and never pass through our systems at all.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission.

3. Accuracy and timeliness of information

We are not responsible if information made available on this site is not accurate, complete or current. The material here is provided for general information only and should not be relied upon as the sole basis for a decision. Any reliance on it is at your own risk. We reserve the right to modify the contents of this site at any time, but have no obligation to update any information on it.

4. Modifications to the service and prices

Prices are subject to change without notice, because they follow the daily gold rate. The price you are shown at checkout is the price you pay: it is fixed the moment you press pay, whatever gold does the following day.

We reserve the right to modify or discontinue the Service, or any part of it, without notice, and shall not be liable to you or any third party for any such modification, price change or discontinuance.

5. Products and services

Certain products may be available exclusively online. They may have limited quantities and are subject to return or exchange only in accordance with our returns policy.

DLV sets only lab-grown diamonds, made by chemical vapour deposition. These are not mined diamonds, and we say so on every product page and invoice, and on any certificate you add.

We have made every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that your screen’s display of any colour will be accurate.

We reserve the right to limit sales to any person, geographic region or jurisdiction, to limit quantities, and to discontinue any product at any time. All descriptions and pricing are subject to change without notice.

6. Accuracy of billing and account information

We reserve the right to refuse any order. We may limit or cancel quantities purchased per person, per household or per order, including orders placed under the same account, the same card, or the same billing or shipping address. If we change or cancel an order, we will attempt to notify you using the email address or telephone number given at the time of the order.

You agree to provide current, complete and accurate purchase and account information, and to update it promptly so that we can complete your transactions and contact you as needed.

7. Third-party links and tools

We may provide access to third-party tools which we neither monitor nor control. They are provided as is and as available, without warranty of any kind. Your use of them is at your own risk, and you should be familiar with the terms on which the relevant provider offers them.

Third-party links on this site may direct you to websites not affiliated with us. We are not responsible for their content or accuracy and accept no liability for their materials, products or services. Complaints regarding a third party should be directed to that third party.

8. Comments and other submissions

If you send us creative ideas, suggestions, proposals or other materials, whether at our request or not, you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium. We are under no obligation to keep them confidential, to pay compensation for them, or to respond to them.

You agree that your comments will not violate any right of any third party, and will not be libellous, unlawful, abusive or obscene, or contain malware. You may not use a false email address or pretend to be someone other than yourself. You are solely responsible for any comments you make.

9. Personal information

Your submission of personal information through the store is governed by our privacy policy.

10. Errors, inaccuracies and omissions

Occasionally there may be information on this site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any such error and to change or update information, or cancel an order, if any information was inaccurate — including after you have submitted your order. Where an order is cancelled for that reason, you are refunded in full.

11. Prohibited uses

You are prohibited from using this site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any regulation, rule, law or ordinance; to infringe our intellectual property or that of others; to harass, abuse, insult, harm, defame, intimidate or discriminate; to submit false or misleading information; to upload viruses or malicious code; to collect or track the personal information of others; to spam, phish, pharm, pretext, spider, crawl or scrape; for any obscene or immoral purpose; or to interfere with the security features of the Service. We may terminate your use of the Service for violating any of these.

12. Disclaimer of warranties and limitation of liability

We do not guarantee that your use of our service will be uninterrupted, timely, secure or error-free. Only warranties explicitly set out on the relevant product page apply to that product.

You expressly agree that your use of, or inability to use, the service is at your sole risk. Except as expressly stated by us, the service and all products delivered through it are provided as is and as available, without representation, warranty or condition of any kind.

In no case shall Dev Labtech Venture Limited, our directors, officers, employees, affiliates, agents, contractors, suppliers or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data or replacement costs, arising from your use of the service or any product procured through it. Where such an exclusion is not permitted by law, our liability is limited to the maximum extent the law allows.

13. Indemnification

You agree to indemnify, defend and hold harmless Dev Labtech Venture Limited and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or your violation of any law or the rights of a third party.

14. Severability and termination

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed without affecting the validity of the remaining provisions.

These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by ceasing to use our site. If we judge that you have failed to comply with any provision, we may terminate this agreement without notice, and you remain liable for all amounts due up to the date of termination.

15. Entire agreement

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of it. These Terms, together with any policies posted on this site, constitute the entire agreement between you and us and supersede any prior agreements or proposals. Any ambiguity shall not be construed against the drafting party.

16. Governing law

These Terms, and any separate agreement under which we provide you services, are governed by and construed in accordance with the laws of India, without regard to conflict of laws principles. Disputes, if any, shall be subject to the jurisdiction of the courts located in Surat, Gujarat, India.
